Terms of use and sale

Last updated: October 20, 2026

These terms set the rules for notary offices using the notadraft.com site and the NotaDraft service: what the Service does, what each party commits to, and how the subscription works. A question about any point? Write to us.

1. Who we are

"NotaDraft", "we", "us" and "our" refer to the company that publishes and operates the Service. To reach us: contact@notadraft.com.

  • The Service means the notadraft.com site and the NotaDraft web app: reading the documents, checks, preparing draft acts, and act templates.
  • The Office or "you" means the notary office that holds a subscription, represented by the notary in charge.
  • Users are the people at the Office who have an account: the notary, clerks and secretaries.
  • File data means the documents uploaded to the Service, the information in them, and the Office's draft acts and templates.

2. Acceptance and changes

By using the Service, the Office accepts the latest version of these terms, along with our privacy policy and data processing agreement, which form part of them.

These terms may be amended; the applicable version is the one published on this page, on the date shown. Any significant amendment is notified to the Office by email at least 30 days before it takes effect, and an Office that refuses it may cancel its subscription before then.

Our tolerance of a breach, even a repeated one, does not prevent us from relying on these terms later.

3. What NotaDraft does, and what it doesn't

NotaDraft reads the documents in the file, flags the inconsistencies it detects and prepares a draft act in Arabic. It is a drafting aid.

NotaDraft does not replace the notary's reading of the original documents, nor the notary's checks or advice. Automatic reading can contain errors, and the checks it offers are not exhaustive. The notary reviews every part of the draft against the original documents, corrects it where needed, decides and signs. Responsibility for the act, its validity and the duty to advise remains entirely the notary's.

NotaDraft gives no legal advice. NotaDraft's standard wording is a starting point the Office adapts. When the Office uses its own template, NotaDraft proposes the passages to fill in and the Office approves them; the template's wording remains the Office's.

4. Accounts and access

  • There is no open sign-up: we create accounts at the Office's request. The Office names an administrator (normally the notary in charge), who manages its act templates among other things.
  • Each User has their own account. Login details are personal and must not be shared.
  • The Office is responsible for its Users' activity and for keeping their passwords confidential. It tells us immediately if it suspects unauthorised access, and asks us to close the account of anyone who leaves the Office.
  • The Office makes sure it has the right to process the client data it uploads to the Service: for that data, it is the controller and NotaDraft acts on its behalf (see the data processing agreement).

5. Acceptable use

The Service is for the Office's notarial work only. The Office agrees not to:

  • use it for unlawful purposes, or to process documents unrelated to one of its files;
  • try to access another office's data, get around security measures or disrupt the Service;
  • copy, decompile or resell the Service, or make it available to third parties.

Clearly abnormal use (automated use, for example) will first be discussed with the Office.

6. Subscription, prices and payment

  • Subscriptions are per office, monthly or yearly, at the prices shown on the site on the day of subscription. The invoice states the applicable taxes.
  • Each plan includes a number of scans per month. A scan is one document read by the Service, whatever its number of pages. The count starts again on the 1st of each month; unused scans are not carried over. Once the number is reached, documents are no longer read until the next month or until the Office moves to a larger plan.
  • Automatic recognition of the documents is a paid option, switched on at the Office's request.
  • The subscription is paid in advance, on receipt of the invoice, by the payment methods it states.
  • If payment is late and a reminder goes unanswered for 15 days, we may suspend access to the Service until payment. The Office's data is kept during the suspension.
  • We may change our prices. For a current subscription, we notify the Office by email at least 30 days in advance; the new price applies from the next period, and the Office may cancel before then.

7. Term and cancellation

  • The subscription renews automatically for the same period unless cancelled before the current period ends.
  • The Office can cancel at any time by writing to contact@notadraft.com from its administrator's address. Cancellation takes effect at the end of the paid period; the current period is not refunded pro rata.
  • We may suspend or end the subscription for a serious breach (non-payment, unlawful use, a threat to security) after a formal notice that goes unanswered for 15 days, or immediately if the security of the Service or the data requires it.
  • When the subscription ends, access is closed. Before then, the administrator can download the Office's act templates. The Office's data is then deleted within 30 days, and from our backups within 60 days.

8. Availability and changes to the Service

NotaDraft's obligation is one of means: we take reasonable steps to keep the Service accessible and working properly, but cannot guarantee permanent availability. Maintenance is scheduled outside offices' opening hours wherever possible.

The Service evolves: we may add, change or remove features. If a change removes a feature essential to the Office, we let it know in advance.

9. Data and confidentiality

File data belongs to the Office. We process it only to provide the Service, on the Office's instructions, as set out in the data processing agreement.

  • Data is hosted in Algeria, and documents are read on our servers in Algeria.
  • Scans are deleted as soon as the act is generated.
  • Documents are never used to train an artificial intelligence, or for anything other than the Office's file.
  • Our staff are bound by professional secrecy (law 18-07, art. 40). A member of our team accesses an office's data only to help it at its request, to keep the Service secure, or when Algerian law requires it.

Personal data of Users and site visitors is handled as described in our privacy policy.

10. Intellectual property

The Service, its software, design, brand and standard wording belong to NotaDraft. The subscription gives the Office a personal, non-transferable right to use the Service for its duration, and no other right.

The Office keeps all its rights in its documents, acts and templates. It allows us to process them only to provide the Service to it. Acts prepared with NotaDraft belong to the Office.

11. Liability

NotaDraft is liable for direct, proven damage caused by its own fault in providing the Service. Except in cases of fraud or gross negligence, its total liability is limited to the amounts paid by the Office in the 12 months before the event giving rise to it.

NotaDraft is not liable for:

  • the consequences of an act signed without the notary checking its content, or errors and omissions in the documents provided;
  • indirect damage, such as loss of clients, reputation or revenue;
  • use of the Service contrary to these terms, or access obtained with a User's login details;
  • force majeure as defined by Algerian law.

12. Governing law and disputes

These terms are governed by Algerian law. In case of dispute, we first seek an amicable solution for 30 days from the written complaint. Failing that, the dispute goes before the competent Algerian court.

These terms exist in French, Arabic and English. If the versions differ, the French version prevails.
